Submission Type: Cancel explanation and redress request

1. Your registered Boat Name: Jammin

6. Rule(s) applicable: 11, 16.1, 17.1, MLS rules 3.2.2 and 3.5.1a

7. Boat(s) involved: No Mercy, Defender, Regis Bra

8. Description: At 12:52:00 Jammin is on port approaching Defender and No mercy on starboard. Jammin easily clears Defender but is in 2 minds about being able to cross No Mercy and decides last seconds to do a very close nose tack on No Mercy. At no point on Jammins replay is there contact or avoiding manouvres from No Mercy therefore Jammin keeps clear. There are 2 distinct movements wich might be lag. No Mercy steers towards Jammin as Jammin completes his tack which would cause No Mercy to break rrs 16.1 if shown to cause contact on their replay. No mercy does a small jump backwards after this but Jammin does no jump forwards and as stated there is no contact on Jammins replay.

After this Defender gains an overlap and is sailing high for a long period luffing to around 25 twa to put pressure on both Jammin and No Mercy who are under rrs11 to Defender and No Mercy under rrs11 to Jammin. Maybe this means Defender is breaking 17.1 as he is sailing above his proper course after gaining an overlap on Jammin?

26s after Jammins nose tack on No Mercy At 13:18:00, No Mercy breaks rrs11 with Jammin as Jammin tries his best to keep clear of Defenders luffing.

At 13:35:00 No Mercy gets a second rrs11 from Defender.

26s After recieving the first rrs11 from Jammin at 13:44:00 No mercy unexpectedly and sharply luffed into Jammin giving him no chance to keep clear and a nadeo pen 11. As there was initially a good distance between them, Jammin believed this broke 16.1 and so immediately asked for cancellation. No mercy, clearly annoyed at Jammins nose tack (see the in game chat) and resultant nadeo pen 11s, failed to respond to Jammins request.

Re: the other cancel explenation Jammin recieves another incorrect pen 10 at the windward mark from Regis Bra a teammate of No Mercy. So now Jammin has 2 pens and 2 pending pen requests. There is a long delay to both request and Jammin starts to get flustered. Regis Bra eventually cancels after the dog leg over 30s after the request was made?

Jammin, asks both Regis Bra and No mercy several times to respond. And after hoisting his spinnaker, Jammin realises No mercy has been removed from the game after leaving it too late to clear 2 pens and gets a 3rd rrs44.1.

Jammin himself has waited as long as he could for a response. Unfortunately Jammin now finds himself with 5s left to clear his pen and in a position of making a close gybe to clear Defender who is behind and slightly to leeward. If Jammin was to luff to windward clear of any other boats he would have got a 2nd pen rrs44.1 from nadeo. Knowing this Jammin chose to attempt the spinnaker drop and gybe across Defenders bow.

As Jammin hoists his jib and stears into the gybe, defender makes a 10 degree bear away towards Jammin and holds course. At this point it is clear to Defender that Jammin is taking a 360 as he has been involved all along since the innitial lee bow tack of Jammin on No Mercy. Not to mention Jammins spinnaker coming down and a slow continuation of his luff into a 360. Instead of returning to his proper course on port and or luffing to avoid Jammins stern, Defender decides to gybe into Jammins 360, causing himself to get a pen 11 which he cancels and writes protest. By this time Jammin is so confused and fed up with the whole situation he carries on regardless.

If No mercy had kept clear twice, NoM and Regis had answered the cancellation requests in good time and Defender hadnt sailed so aggresively searching for contact and difficulty, We would all have been in a much happier place. If I deserve DSQ for my 360 into Defender so be it, but I feel I deserve exoneration at least if not redress as well for the Chaos No Mercy caused.

Respect to the PC for however you rule on this one, I wait with interest.

Facts:
Jammin less than half a boat width to windward of Nomercy for a long period.
Jammin does not do anything to increase the gap.
Jammin requested to cancel a penalty from Nomercy which was not approved.


Conclusion:
Jammin broke rule 11 as Nomercy could not luff without making immediate contact.
Nomory broke MLS rule 3.2.2 by not cancelling.

Decision:
Jammin to be disqualifed in the race.
Nomercy to be disqualified in the race.
