8. Description:
I am fetching mark inside zone and SAF is leeward to me. As I tack I receive a pen 13. I think I have right of way and according to rule 18.2 I must be able to parse marke. SAF is not giving me enough room. Actually he luffs up and thereby SAF breakes rule 18.2 / 16.1.

Fact:

Batboat and SAF, both on starboard and overlapped, sailing for the mark, mark to be left to starboard.
Batboat is inside overlapped to windward of SAF. As Batboat is at the mark, Batboat tacks to round the mark, Batboat receives a pen as he is tacking, there is contact between boats.

SAf is to give Batboat mark-room under RRS 18.2b, and in this situation also give Batboat room to tack, as per the definition of mark-room.
FromWorld Sailing's 2017-2020 Racing Rules of Sailing:
"Mark-Room Room for a boat to leave a mark on the required side. Also,
(a) room to sail to the mark when her proper course is to sail close to it, and
(b) room to round the mark as necessary to sail the course.
However, mark-room for a boat does not include room to tack unless she is overlapped inside and to windward of the boat required to give mark-room and she would be fetching the mark after her tack."

Decision:
Batboat pen cancel accepted, no further action.
SAF DSQ for breaking RRS 18.2b and definition of mark room.
