7. Description: At the first upwind Fiducit and I are sailing on port tack. Fiducit tacked to Stb, and beared away to cross behind ElMoro. That move was spoken on teamspeak. Ingame umpire gave a penalty (10) to ElMoro, but that was a wrong one. There was a lot of space between Fiducit and ElMoro and Fiducit beared clear away and ElMoro didnt have to move to keep clear. So ElMoro asked for cancellation and FIDUCIT III did.

Facts:
Elmoro on port, approach Fiducit on starboard. Before Elmoro's bow reaches the point ahead of Fiducit's bow, Fiducit bears away constantly and passes behind Elmoro.

Conclusion:
Elmoro was initially keeping clear. He could have tacked to leeward of Fiducit if the latter had held his course.
When Fiducit was bearing away, he had to give room to Elmoro to keep clear (RRS Rule 16.1), which he did.

Decision:
No rules broken.

Note:
It doesn't matter that two boats are on the same team and communicates per voice. If the boat is in a position where she is not able to keep clear before the other boat is changing course, then she has not kept clear.
