8. Description: Me on porttack, SPX on Stb tack. SPX aproaoching me, i luffed and beared down to get off his line. During that he tacked immediatly. While tacking i get pen Rule 10. SPX tacked to close to me and i had no chance ( in seamans way ) to give him room. I protested him for Rule 16.1(When a right-of-way boat changes course, she shall give the other boat room to keep clear.)

Sorry i forgot to say, that i requested cancellation and SPX 103 agreed.

103 SPX on starboard tack, Fiducit III on port tack crossing ahead of 103 SPX. Fiducit III can not continue without avoiding 103 SPX. Fiducit III luffs to avoid 103 SPX's bow. At the same time 103 SPX, as Fiducit III had no room to cross clear ahead of her, tacked leeward to Fiducit III but contact was inevitable.

In my opinion Fiducit III on port tack had to respect RRS 10 which he failed to do

Facts:

Fiducit fails to keep clear under rrs10.
103spx tacks leeward & close to Fiducit to prevent imminent collision and avoids being stopped or slowed down.

Cancellation request REFUSED >>> Fiducit DSQ
Protest against 103spx DISMISSED >>> No further action against 103spx
