8. Description:
During prestart I was tacking to starboard. I reached close hauled clear ahead of Frenito.
Frenito was sailing faster and shortly after he became windward overlapped.
Frenito does not alter her course after I became right of way boat after the tack. There was a collision between our boats.
I received RRS 15 penalty which I consider incorrect. I believe RRS 11 was broken by Frenito.
My RRS 15 was cancel and the protest hail against Frenito was raised.

Facts:

At 01:49 Pawel is back on close hauld course, since he is clear ahead of Frenito, Pawel is ROW boat. Frenito do not at any point change course, in order to keep clear of Pawel. At 01:54 there is contact. Yes RRS is turned on when Pawel is back on close hauld corse, but Frenito is also obligated to emmidiately take action to keep clear. At no point does Frenito do any to try to keep clear, therefore, PC finds it is a RRS 11 for Frenito.

Decision:
Pawel cancel accepted, no further action.
Frenito break RRS 11, and DSQ.
