Facts:

The overlap was clearly established by 103 SPX from clear astern. Therefore, RRS 17 apply. There is no way that 103 SPX can reach the mark on this tack. Trying to go over close hauled is definetly higher than the proper course. By luffing over her proper course he breaks RRS 17.

Decision:

Explanation REJECTED
103 SPX DSQ for breaking RRS 17.
