MLS S12 - Day 4 - Blue Server - Race 3 - Cancel Explanation

Post by Toppen »

Submission Type: E

1.Your registered Boat Name: Jimi

2.Race Day: 4

3.Group (colour): Blue Server

4.Race (number): 3

5.Time (in Replay): 01:48:00

6.Rule(s) applicable: 10, 13 and 22.2 instead of 16.1

7.Boat(s) involved: Jimi and Duffy

8.Description:
Duffy was on port before start, and received RRS10 from Fiducit.
Duffy decided to do his penalty turn, and Jimi had to luff for the first time in order to avoid contact
Then, Duffy didn't complete his penalty turn, and tacked to solve it.
Jimi had to luff for the second time in order to avoid again Duffy.
Then, Duffy tacked again to be STB, and there was mast hit between Duffy and Jimi.
Jimi received RRS16.1, asked to cancel, and Duffy accepted.

So IMO, I think Duffy broke :
- RRS10 and RRS22.2 when there was Jimi's first luff
- RRS10 when there was Jimi's second luff
- RRS13 when there was mast hit between both boats

Facts:
Duffy gybes from starboard to port to windward of Jimi, while taking a penalty turn.
Jimi does not change course, and hits Duffy on the leeward side near the stern.
Duffy continues to turn and tacks in front of Jimi's bow.
Jimi luffs to avoid collision, then bears away and there is contact between the masts.
Jimi receives a penalty from the VSK umpire under Rule 16.1, which he cancels.

Conclusion:
Duffy did not keep clear of Jimi and broke rule 22.2. Jimi did not break rule 16.1 when he changed course, because his course change did not remove the ability for Duffy to keep clear, as Duffy was already not keeping clear. Jimi did not break rule 24.2 when he interfered with Duffy while Duffy took a penalty, because it was not reasonable for Jimi to sail off his (straight) approach to the start line only because Duffy did not get well clear before taking a penalty turn. Jimi's cancellation accepted. Duffy to be scored RET in the race.

Note:
Duffy originally got a penalty from VSK under rule 10 when passing in front of Fiducit. That cross was not even close to being a rules violation, and it was not necessary to take a penalty.
