Facts:
Kvien Mary was clear ahead and windward of Pirata.
Pirata became overlapped to leeward of Kvien Mary within 2 boat lenghts.
Pirata luffed and sailed clear astern of Kvien Mary.
Pirata got at penalty from the VSK umpire under Rule 17, which he cancelled.

Conclusion:
Pirata sailed above proper course, but sailed promptly behind the other boat, so did not break rule 17.
