8.Description: We were almost turning the mark for second upwind and I gave all the time enough space to Bat Boat turn, It's clear he had all the space he needs to do his move clean. I could not go more down because we had other boats under me.

Facts:
Pirata is overlapped to leeward of Batboat when he enters the zone around the mark.
Both boats bears away, and when Batboat is pointing just below the mark, the gap between the boats is 1/3 boat width.
Batboat continues to keep clear away, and when pointing 1/2 boat length to leeward of the mark there is contact between the boats.
Pirata get a penalty from the VSK umpire under rule 18.2(a) which he cancels.

Conclusion:
Pirata gave Batboat mark-room, which initially is to sail to the mark. Batboat broke rule 11 and cannot be exonerated from this unde rule 21 because he used more room than he needed. Batboat to be scored DSQ in the race.
