MLS S13 Day 4 Green Server Race 12 - Protest

8. Description:
A2-Mover and BatBoat are fetching top mark. Jonte tacks within the zone from port to starboard. Inside the zone Jonte tacks back from starboard to port. The consequences of the last maneuver is that A2-Mover is hit (slowed down) and has to go above closed hauled to try to avoid Jonte which is impossible.

There are a number of rules being broken but I do believe that Jonte should have realized that there is no room and Jonte by doing this is not in compliance with recognized principles of sportsmanship and fair play and therefore Jonte is in conflict with rule 2.

And even though Jonte receives a penalty he gains an advantage by breaking the rules which is also not acceptable.

Facts:
A2-Mover on starboard layline.
Jonte enters the zone on port, and tacks to starboard to leeward of A2, 2 boat widths below the layline.
Jonte then tacks again, and while tacking, A2 mover has to luff to avoid contact.

Conclusion:
Jonte did not keep clear and broke RRS Rule 13. Jonte caused A2 to sail above closehauled after tacking in the zone and broke RRS Rule 18.3. After Jonte's first tack, it was clearly not possible to pass the mark without breaking the rules, hence Jonte broke RRS Rule 2 by double tacking around the mark. Jonte to be scored DNE in the race.
