7. Boat(s) involved: Valodea, Moleke

8. Description: Valodea rounds the gybe mark ahead and inside of Jammin and Moleke. He decides to go for spinnaker which ends up being a bad call as both Jammin and Moleke continue with sail 3. Not wanting to risk hitting Valodeas stern Jammin stays outside Valodea who is going slower because of the hoist and a bad mark rounding. Valodea takes mark room for 2 boats on the exit. Valodea with spin sails between 20-30 degrees off proper course to the next mark after exiting the mark.

At 24:26:00 Valodeas stern clears the gybe mark.
1s later Jammin gains an overlap with his bowsprit. 18.2 for Jammin ends and 11 for Valodea begins.
1.5s later Jammin gets full overlap with bow.
1.5s later Jammins stern clears the gybe mark.
3.5s later Valodea eventually luffs to avoid Jammin. Thats 6.5 seconds after Jammin gained overlap and waited for valodea to luff.
2s later Valodea stops luff in what looks to be lag as moleke does same movement on Jammins replay. Jammin gets a 16.1 from nadeo.
2s later there is contact.
1s later Jammin is free to sail his proper course to the next mark and asks for cancel.
over 30s later Valodea eventually cancels Jammins request for cancellation.

Jammin luffed very late and gently and gave more than enough room and time for Valodea to either luff earlier and harder to avoid breaking RRS11 or at the very least he had plenty time to drop his spinnaker and revert back to sail 3 before contact from Jammin. Furthermore there is lag and Moleke to leeward of Jammin who he needs to avoid.

Valodea then goes off on a bizarre course completely missing the following mark and does a couple of random 360s. Too many whiskys perhaps?? :)

Facts:
Jammin establishes a leeward overlap on Valodea, both to windward of Moleke and on a lower course than him.
Valodea holds his course for 3 seconds, closing the gap to Moleke to less than 1 boat width.
Jammin luffs and hits Valodea on his leeward side.
Valodea takes a 360 turn 20 seconds after getting clear of other boats.



Conclusion:
Jammin gave Valodea room to keep clear according to rule 15.
Valodea did not keep clear of Jammin and broke rule 11.
Valodea did not give Jammin room to pass to windward of the obstruction (Moleke) and broke rule 19.2(b).
Jammin broke rule 16.1 but is exonerated under rule 43.1(b) as he sailed within the room (for obstruction) he was entitled to.
Valodea did not take a one-turn penalty according to rule 44.2.

Decision:
Cancel accepted.
Valodea to be disqualified in race 5.
