8. Description: At 30 :00.76 Batboat goes well beyond proper course and within the zone when Donmasino gybes get a 18.2.a.

Then, instead of keeping clear having the space to do hits 360 turn, Batboat sails parallel to the arrival line. When near to arrival I attempted to avoid collision but Batboat luffed towards me causing at 30 :24.80 a pen 11. Besides, he had hoisted the jib and could rest so as not to do any damage. Donmasino, as seen in the video, despite having the spinnaker behaved correctly, avoiding damaging the other players.The subsequent request for cancellation was not answered by Batboat. This caused me loss of time and positions.

I request DSQ for Batboat and redress for the evident damage caused.

Facts:
Thor half a boat length to windward of Batboat, almost parallell courses just before the finish line.
Batboat luffs hard and there is contact between the boats.
Thor luffs to separate from Batboat and goes into a broach.
Duffy finishes in 8th position.
Thor requests cancellation which is impossible for Batboat to accept because he has finished.
Thor cross the finish line in 9th position.



Conclusion:
Batboat did not give Thor room to keep clear under rule 16.1 when he luffed.
With the relative position of the boats, it was clear that a hard luff would result in an unavoidable collision.
The collision is therefore considered as a deliberate action.
A deliberate breach of the rules is a violation of the recognized principles of sportsmanship and fair play, hence a breach of rule 2.
Thor broke rule 11, but is exonerated under rule 43.1(b).
Thor was forced into a broach and lost 1 position when Batboat broke rule 16.1, and is entitled to redress under MLS rule 3.5.1(e).

Decision:
Batboat is disqualifed (DNE) in race 4.
Thor redressed to 8th place.
Duffy redressed to 9th place.
No other scores changed.
