MLS 14, day 4, group red, race 1, protest vs. Damian HDT

Post by FIDUCIT_III »

Submission Type: Protest

1. Your registered Boat Name:FIDUCIT III VSKFunsters

2. Race Day:4

3, Group (colour):red

4. Race (number):1

5. Time (in Replay):from 24:08 til 24:30

6. Rule(s) applicable:18

7. Boat(s) involved:Damian HDT, Galaxy HDt, John Pap HDT

8. Description:on the downwind ,fetching the right gatemark, Damian as my inside boat took to much markroom, forced me to get a pen, and let 2 Teammates Galaxy and John Pap sneaking inside rounding the mark. Neither Galaxy nor John Pap established overlap to me or Damian before the zone to get ROW to Damian at the mark. So Damian wasn´t forced by any inside boat to take more markroom than needed. Both, John Pap and Galaxy had to keep clear of Damian and me and had to give markroom to Damian and me. Both didnt, beacause Damian let them in.
I was on 10th or 11th place at the mark and ask also for redress.

Facts:

Overlap between JohnPap, Damian and Fiducit at zone entry.
Galaxy clear astern.

Conclusion:
Damian did not keep clear of Fiducit when he gybed to port before reaching the zone and broke rule 10.
Galaxy did not give mark-room to Damian and Fiducit and broke rule 18.2(b) and 18.2(c).
Fiducit volunteered to take a penalty which he could have cancelled.

Decision:
Damian to be disqualified in the race.
Galaxy to be disqualified in the race.
No grounds for redress to Fiducit.
