7. Description: At 12:04 i am on port tack upwind and crossing behind LAJ2 and Jammin who are both on stb and on layline to the first mark.Pirata is still on STB. At 12:06 Pirata tack on Port and bears to also cross behind LAJ2 and Jammin. At 12:12 i give room to Pirata to cross between my boat and behind Laj2 and Jammin as he have created overlap with JohnPap and i luff 1 boat lenght away of the layline waiting for Pirata to tack on the layline. At 12:15 Nadeo gives me a pen 13 while i still was more than a half boat lenght from Pirata and Pirata already started his tack to Stb on the layline. I believe that pen is not correct and i asked to cancel.

Facts:
JohnPap to leeward of Pirata, luffs slowly, then passes head to wind. Pirata luffs a little, then holds her course after JohnPap has passed head to wind. When the boats are 1 boat width apart, Pirata luffs hard and tacks.

Conclusion:
Pirata could not sail her course with no need to take avoiding action. JohnPap was not keeping clear and broke rule 13.

Decision:
JohnPap is disqualified in the race.
