6. Boat(s) involved: Water Gipsy HDT

7. Description: Fiducit fetching topmark on starboard tack, Water Gipsy leeward of me, some other boats windward on layline to mark. Water Gipsy tacked in the zone to port to catch the mark.I tried to keep clear and mentioned not to make the mark without a tack. So i decided to bear down to round the mark after the fleet. Water Gipsy never tried to bear down but stayed on port tack. He stopped me dead. He broke Rule 2 and i ask for redress because i lost 1 minute until i could round the mark.

Facts:
Watergipsy to leeward of Fiducit just before the windward mark. None of them are able to pass the mark without tacking in the zone. Watergipsy tacks in front of Fiducit's bow and stops him.

Conclusion:
Watergipsy deliberately broke rule 13 and therefore also rule 2.

Decision:
Watergipsy to be disqualified in the race (DNE).
Fiducit is not entitled to redress, as his score was not significantly made worse. In order to pass the mark, he would have needed to make a 360 turn counter clockwise, and would have passed the mark near Elmoro. At the next windward mark, he was near Elmoro.
