1.Your registered Boat Name:
Batboat

2.Race Day:
3

3.Group (colour):
Green

4.Race (number):
2

5.Time (in Replay):
17.44

6.Rule(s) applicable:
11 / 16.1

7.Boat(s) involved:
Batboat and Sailor

8.Description:
Batboat and Sailor are on starboard tack (spinaker). Time: 17.47 Batboat Gybes to port and afterwards becomes leeward boat. After the gybe, there is a good distance between the boats. From 17.48-17.52 Sailor falls against Batboat. Batboat makes a minor course change and the penalty is triggered around time 17.54. It is my opinion that Sailor has enough time to change course after the gybe, but instead chooses to fall close to Batboat, which is contrary to rule 11.
Sailor should DSQ for violation of rule 11

9.Print Screen attached (required for a manual protest):
No

10.Replay attached (required):
Yes

Sailor-Ger, can you please submit your replay here, in order to document any lag on your end in this situation?

always the same with BatBoat
Can't see any fault with me. Did the same course as the boats before me. John Pap and ZEZ. after the jibe, BatBoat did not go the right course, wanted to chase me. He got a 16.1. I didn't protest. I think BatBoat deserves a DSQ. He broke rule 2. (Fair play)

A youtube video won't help us.
Can you submit the VSK replay file, which were recorded on your computer during the race?

You may retire from the race, in which case the case is closed.
If you do not retire, the protest committee will decide the situation

This is not your replay. This is a copy of Batboats replay. Don't you have your replay anymore on file?

A situation that involves a cancellation does not require a hail.
See MLS rule 3.1.5.

Facts:
Sailor-GER and BatBoat on downwind leg, both on starboard.
Both boats gybes, and Sailor-GER now to windward of BatBoat.
Sailor-GER on a lower course, closing the gap to Batboat.
BatBoat luffes slightly, Sailor-GER does not react, and there is contact.
Batboat get a penalty from the VSK umpire under rule 16.1, which he cancels.

Conclusion:
Batboat gave Sailor-GER room to keep clear.
Sailor-GER did not keep clear.
Sailor-GER to be scored DSQ for breaking rule 11.

Note:
According to MLS rule 2.5, each boat will be judged based on their own replays, if available. Some lags were present in the host replay, which is why we wanted to check both replays in this case. If the other replay had shown quick "lag-luff", Sailor-GER could have been exonerated. Sailor-GER did not submit his own replay, but sent a copy of Batboat's replay, which means he will be judged based on this replay.

There is no rule that says a boat shall sail the shortest/quickest route to the next mark (proper course), except when subject to rule 17 or 18.4. It is allowed to use the rules tactically to gain an advantage. This attempt doesn't either have to be successful or tactically smart. Here there was a big gap down to the trailing boats, so there were no risk losing positions. Only if a boat sails in a way to "take out" another boat, and is losing places for her (or her team), such a maneuver would be a violation of rule 2.
