Facts:
LuisRomAbar on port inside overlapped of Jammin Dovetails on port at zone entry.
Jammin Dovetails sails to round tight around the mark.
LuisRomAbar gybes to staboard pointing just to the side of the mark, then holds his course.
Jammin Dovetails passes 1/2 boat width in front of LuisRomAbar.
Jammin Dovetails receives a penalty from the VSK umpire under rule 10, which he cancels.
LuisRomAbar gybes and rounds the mark 1/2 boat length below the mark.
Conclusion:
Jammin Dovetails kept clear and gave mark-room to LuisRomAbar.
Cancel accepted.
Note:
There was doubt whether Jammin Dovetails could have given mark-room if LuisRomAbar had rounded closer to the mark. However, it is of the understanding of the protest committee that the extra margin LuisRomAbar sailed with was due to lag on his computer which started when he gybed to starboard. This lag can be seen both in the replay and in the video. For this reason, the benefit of the doubt is given to the accused (Jammin Dovetails).
