BatBoat and Venhobel is approaching mark. There is no overlap when BatBoat reaches the zone. Rule 18.2.B, applies and Venhobel shall therefore stay clear even overlap is established later, cf. 18.2.C(1).

Venhobel shall be DSQ for breaking rule Rule 18.2.B / 18.2.C(1)

In video you can see on radar that overlap is not established when reaching zone.

Facts:
Batboat enter the zone clear ahead of Venhobel.
Batboat sails towards the mark.
Venhobel becomes overlapped inside Batboat and hits him and the mark.
Batboat gets a 11 penalty from VSK which he cancels.
Venhobel takes a 360 turn right after the mark.



Conclusion:
Batboat was entitled to mark-room and sailed within this mark-room.
Venhobel didn't give mark-room and broke rules 18.2(b),18.2(c) and 31.
Batboat broke rule 11 but is exonerated under rule 43.1(b).
Venhobel took a one-turn penalty according to rule 44.2.

Decision:
Cancel accepted.

Note:
It's very useful to record the races to provide evidence to a protest hearing. To provide even more information than in the submitted video, it's recommended to turn on the "ISAF panel" in the top right corner of the screen. That way it becomes clear what the VSK umpire had observed - in this case with regards to overlap status at the zone. What is strange in this case is that the color of Venhobel's boat changes inside the zone before Batboat has reached the mark. Due to this, there was doubt about the overlap status at the zone. Batboat was given the benefit of the doubt, as the replay showed that the bow of Venhobel (excluding the bow spirit) was clearly astern of Batboat at zone entry. The MLS rules are updated for the next round to include the TP52 bowspirit. It's not included for RC44, because VSK does not consider it as part of the boat.
